The Legal Entities Registry was created as a
system that was independent and different from the Real Estate Registry,
based on studies of processes for the reorganization of the National
Registry. The studies determined the
need to establish the Legal Entities Office, understood in practical terms as
a Legal Entities Registry, which had administrative and budgetary
independence, as is the case for any de-concentrated body that is a part of
the National Registry. The demand for services had increased so rapidly
during the last few years that the Real Estate Registry (whose specialty was
entirely different from that of Legal Entities) started to experience
limitations on its ability to meet needs for equipment, furniture, staff, and
other resources, which in turn affected service quality.
Being well aware of this situation, the
National Registry Board of Directors issued an administrative agreement in Ordinary
Session Nš 058-97, of October 30, 1997, whereby the Legal Entities Office was
formally established, in conformity with the proposals of the final document
for reorganization of the National Registry. This proposal was supported
by the Ministry of Planning (MIDEPLAN)
through legal document Nš DM 133-98, of March 5, 1998, and was made official
with the promulgation of Executive Decree Nš 26771 - J, "Regulations of the
Public Registry", of March 18, 1998, in which its organizational structure
was defined.
Executive Decree Nš 28541-J of March 29,
2000, created the Legal Entities Subdivision, the Registry Coordination
Office, and the Registry Services Coordination Office to provide the Legal
Entities Registry with a structure similar to those of other Registries.
Official document N.š DM 007-01 of the Ministry of the
Presidency and of the Ministry of National Planning and Economic Policy of
February 6, 2001 ratified the new structure of the current Legal Entities
Registry, made up of an Executive Office, an Office of Sub-divisions, a
Registry Coordination Office and a Service Area Coordination Office, with
their respective areas.
Finally, Art. 22 of the Law of Procedures of
Compliance with Intellectual Property Rights, Law N.š 8039, of October 27,
2000, included the Legal Entities Registry as such, whereby its legal
structure as a Registry was established, because it contained a tacit reform
to the Creation of the National Registry Law.
This structure has changed through time due
to constantly emerging needs, driven by the development of this Registry and
the increasing amounts of documents to be registered.
